Balenciaga files lawsuit against Steve Madden

Balenciaga is suing Steven Madden with a trademark lawsuit. The Paris based design house, helmed by Alexander Wang, filed a lawsuit in the US District Court in Manhattan accusing accessories designer Steven Madden of copying its famous motorcycle bag. Balenciaga said that Steven Madden has made a “studied copy” of the bag. Balenciaga argues Steven Madden’s Btalia bag which is being sold for $88, resembles the Motorcycle bag.

The French design house which is owned by parent company Kering has claimed that Steven Madden is manufacturing a cheaper version of their famous Motorcycle bag. This according to Balenciaga has been specifically done to confuse consumers. The company claims that Steven Madden has infringed a trade dress regulation that the Parisian house applied for in 2007. A trade dress regulation is a type of trademark protection. This is a visual kind of trademark where the appearance of the product is looked at.  Trade dress infringement issues arise when a party feels that a copy could result in consumer confusion. The trade dress which was registered by Balenciaga covers the front design of Motorcycle bag and its lookalikes such as Twiggy, Velo, Papier and City (see picture above).

The registration protects: “The flat pouch with a zippered rectangular closure, a zipper pull consisting of a strip centrally-knotted and hanging in two equal lengths, and a semi-elliptical patch outfitted with two raised studs in each corner; and two identical patches in an elongated pentagonal shape, featuring an elongated hexagonal patch outfitted with a buckle and two raised studs”.

The Motorcycle bag has been a celebrity favourite seen on the likes of Kim Kardashian, Mary-Kate Olsen and Paris Hilton. It became so popular that there were many counterfeits on the market. As a result of this, Balenciaga decided to register a US trade dress to protect the design. The bag was created by Nicholas Ghesquiere who was at Balenciaga from 1997 and in 2012 Alexander Wang became his successor.

Balenciaga has asked the court for an injunction to prevent Steven Madden producing the “studied copy” of its Motorcycle bag. The French label is also seeking monetary damages and lost profits. Balenciaga’s complaint states: “Defendant’s wholesale copying of Balenciaga’s designs is likely to deceive consumers into believing that the infringing [handbag] is associated with or authorized by Balenciaga when it is, in fact, not.” In addition, Balenciaga claims not only is there customer confusion but it is also hurting the company’s goodwill, reputation and sales.

This is not the first time Balenciaga has filed a lawsuit against the American designer, Steve Madden. If you remember, in 2007 the company filed a complaint against Steven Madden for “intentionally copying” its LEGO high heel from its Autumn/Winter 2007 Collection.

Pearl Choker

I have been wanting a statement necklace that has pearls in.  All I could find was the traditional one strand pearl necklaces which I already have. I am still on a mission to find a chunky pearl necklaces with many strands. Any ideas?

Many of you may have seen the Zara pearl choker which has been made popular by fashion bloggers. I think its such a elegant yet edgy necklace that can be worn day in and day out.

My love for the pearl choker began when I saw the Chanel Spring/Summer 2014 report and the huge pearl bubble chokers the models were wearing. Then I saw that Zara had a pearl choker which was similar. I put it in my basket and by the time I came back, it was sold out. Sad times indeed!

Nevertheless, there was still hope for my mission to find a similar necklace to the Chanel pearl choker. Yayy, I did end up find up finding something. Topshop also have a pearl choker. They have it in grey too, which I have been thinking about getting.  I am thinking twice about it, the same necklace in two colours. Excessive or Necessary?

It is great to see the influence of designers on the high street, high end designs trickling into high street shops. This means that people can find similar designs for a cheaper price and still feel en vogue. I remember Miranda Priestly telling off Andy in The Devil Wears Prada because she did not understand the importance of designs and how they could impact the ordinary man. Here is a quote of what she said:

Miranda and some assistants are deciding between two similar belts for an outfit. Andy sniggers because she thinks they look exactly the same] Something funny?
Andy Sachs: No. No, no. Nothing’s… You know, it’s just that both those belts look exactly the same to me. You know, I’m still learning about all this stuff and, uh…
Miranda Priestly: ‘This… stuff’? Oh. Okay. I see. You think this has nothing to do with you. You go to your closet and you select… I don’t know… that lumpy blue sweater, for instance because you’re trying to tell the world that you take yourself too seriously to care about what you put on your back. But what you don’t know is that that sweater is not just blue, it’s not turquoise. It’s not lapis. It’s actually cerulean. And you’re also blithely unaware of the fact that in 2002, Oscar de la Renta did a collection of cerulean gowns. And then I think it was Yves Saint Laurent… wasn’t it who showed cerulean military jackets? I think we need a jacket here. And then cerulean quickly showed up in the collections of eight different designers. And then it, uh, filtered down through the department stores and then trickled on down into some tragic Casual Corner where you, no doubt, fished it out of some clearance bin. However, that blue represents millions of dollars and countless jobs and it’s sort of comical how you think that you’ve made a choice that exempts you from the fashion industry when, in fact, you’re wearing the sweater that was selected for you by the people in this room from a pile of stuff

Whether we like it or not, what we wear is somehow shaped by the fashion industry. Miranda’s example was Oscar De La Renta cerulean gowns and Andy’s sweater. There are many examples through history and today. For instance Roland Mouret and his ‘Moon’ Dress, famously worn by Victoria Beckham in 2007, created a frenzy on the high street. Stores such as Topshop had their own version and even Tesco had similar dresses to Mouret’s ‘Moon’ dress.  The Chanel Pearl Bubble Choker, is a clear example of this today.

In love with the colours Black and White

There is no in-between

No such thing as Black+White=Grey,

Not in their minds at least

No such thing as contemporary colours

In their world only primary colours exist

No such thing as tones, shades, tints

No such thing as dots, spots, stripes, waves or spirals

No such thing as an inverted triangle,

A triangle stands upright and has three equal sides

No such thing as a rectangle,

It’s a square with four perfect sides

No such thing as odd numbers,

Even numbers must only exist

In their minds, doors can never be opened,

Doors are always shut

We feed this stereotype all day long,

We Say it’s unhealthy yet

Many still are in love with this stereotype diet

 

The Sun brings light and The Moon is in darkness

The Morning arises and The Night sleeps

This is all so expected

Yet if we said The Moon is The Sun, the Moon will act like The Sun

Checks, Plaid and all things patterns are one of the key trends for Autumn Winter 2013/2014.  I saw this checked top when it first came out and thought to myself let me wait until the sale comes on. When I got to Marks and Spencer, my size wasn’t there *cries*. I looked online and read the reviews, everyone said how they loved the top but you had to go a size up. Can you face the sales?

You will need something comfortable so you can run to get your bargains. A friend of mine, has ‘special trainers’ for the sales so she can whip them off and run to try things on lol. I’m not a trainer girl, so for me anything like flats or low heeled boots is comfortable for me. I usually wait until the 27th onwards to go to the shops, boxing day sales can be a tad manic. Great Women of The Bible Challenge- Jemima & Joanna

 

Jemima- Most beautiful and a women of inheritance

Bible Reference- Job 42:12-15

Family Background- Jemima was the daughter of Job, the eldest of three daughters (sister to Keziah and Keren-Happuch)

Name Meaning- Jemima or Jemimah means dove in Hebrew

Who is Jemima?

Jemima was the eldest daughter of Job. Job, was a blessed man who lived righteously. God sings praises of Job and the Devil challenges Job’s character, suggesting that he only served God because God protects him. God removes his protection and allows Satan to take his children, his health and his wealth but not his life in order to test Job.  Despite what Job went through, he continued to serve, worship and praise God. For this, God restored his fortunes and gave him twice more than he had before. Jemima was born to him after his return to prosperity.

Why is Jemima great?

Even though there is little known about Jemima, she is a great character in the Bible. Not only were her and her sisters the most beautiful women of their time, their father granted them an inheritance along with their brothers. This is unusual especially at that time for women to receive inheritance. This demonstrates that Jemima and her siblings were distinguished women of their time. It was expected for men to receive inheritance but not for women.

What can we learn from Jemima?

It is interesting to see that Jemima and her sisters names were mentioned but not her brothers names. What we can take from this story, is that we can all be great regardless of our gender. It does not matter whether you are a woman or a man you have been called to be great. You may think that because you are a female you can not be in a particular position or achieve something that is not expected. You can! Look at Jemima and her sisters, they were not expected to receive inheritance yet they did.

Family Background- Joanna was the wife of Chuza,the manager of Herod’s household.

Name Meaning- Joanna means God is gracious in Hebrew

Who is Joanna?

We are introduced to Joanna in Luke 8. We are told that Jesus travelled from one town to the other preaching the good news. There were twelve with him and some women who had been cured of diseases and evil spirits. This included Mary Magdalene,  Joanna, Susanna and many others. These women were helping to support using their own means.

We are not told whether she was delivered from evil sprits or healed from a disease. However we do know that Joanna gave her life to Christ and followed him.Her husband who held the position of a steward of Herod’s household suggests that Joanna and her husband had social prominence. It also suggests that they were a wealthy couple.

At the burial of the Jesus, Joanna and the women saw the tomb and his body laid in it. They then went home to prepare spices and perfumes. They stayed obedient by resting on the Sabbath.

Joanna and the rest of women took the spices they prepared and went to the tomb. They rolled the stone away from the tomb but the body was not there. They wondered where the body went, then two men appeared, telling them that Jesus had resurrected. The women including Joanna, Mary Magdalene and Mary the mother of James went to tell the apostles but they did not believe them.

Why is Joanna great?

Before I read this, I did not know much about Joanna. I am so glad I included Joanna as part of the Great Women of the Bible. What strikes me so much about this woman and the others, is their incredible faith. She along with the other women in Luke 24:1-12:

On the first day of the week, very early in the morning, the women took the spices they had prepared and went to the tomb. They found the stone rolled away from the tomb, but when they entered, they did not find the body of the Lord Jesus. While they were wondering about this, suddenly two men in clothes that gleamed like lightning stood beside them. In their fright the women bowed down with their faces to the ground, but the men said to them, “Why do you look for the living among the dead? He is not here; he has risen! Remember how he told you, while he was still with you in Galilee:  ‘The Son of Man must be delivered over to the hands of sinners, be crucified and on the third day be raised again.’ ” Then they remembered his words.When they came back from the tomb, they told all these things to the Eleven and to all the others. It was Mary Magdalene, Joanna, Mary the mother of James, and the others with them who told this to the apostles. But they did not believe the women, because their words seemed to them like nonsense. Peter, however, got up and ran to the tomb. Bending over, he saw the strips of linen lying by themselves, and he went away, wondering to himself what had happened.

Joanna and the women told the apostles that Jesus had risen and they did not believe it. Think about it for a minute, these were the guys that accompanied him everywhere in his ministry, knew him personally and loved him. These same men thought that the women were speaking nonsense.  Yet Joanna spoke boldly to the apostles and told them what she had heard.  She believed that Jesus was crucified and had risen by remembering his words. The bible tells us that faith comes through hearing by Christ which she did. She heard God’s word and believed it. She had great confidence in Jesus. You can tell she cared so much for Jesus by preparing spices and perfumes for his body. The one who cured her disease and her soul became precious to her. She showed this love by supporting him and his followers financially.

Joanna could have lead another life of power and riches, being married to Chuza (manager of Herod’s household). Yet she used the power that she had and found the greatest power of all, Jesus. God then honoured Joanna’s faithfulness by her being one of the first witnesses to the Resurrection.

Joanna was truly great!

What can we learn from Joanna?

The Bible tells us without faith it is impossible to please him. If we wish to draw near to God we must believe that he exists. Joanna and the other women believed in his words, they remembered that Jesus would die and rise on the third day. For this she was rewarded. We can learn from Joanna’s story, to believe in God always. When God tells us something, we should believe, we shouldn’t think it is nonsense like the apostles did or go out and check for evidence like Peter. We should build our confidence in Christ Jesus.

The latest product from Motorola (which is owned by Google) went on sale this month. The, Moto G, is Motorola’s anticipated smartphone since the company’s acquisition by Google.

The mid range smartphone will aim to undercut its rivals on price. It is on sell for £135 or $179. It offers a 4.5  high definition screen, 1.2 GHz processor, Android 4.3 and a choice between 8 or 16 GB storage. Although 16 GB is the maximum storage, there is an option of 50GB online storage for two years. Moto G is available in Latin America and parts of Europe, and would then spread to the US, Middle East and Asia by January.

Motorola seems to be targeting customers who want a smartphone like the iPhone but for less money. Its specifications does certainly cover this. Similar to the iPhone it offers a slow-motion video. Additionally, the device offers a 5MP camera. The company believes that half a billion people are looking to buy smartphones for less than $200. Currently, many do face the choice of low end smartphones or phones that came out some time ago. The £400+ smartphones are simply out of their range. However, it looks like Motorola have understood the market and are now targeting customers who wish to spend less.

It seems that Moto-G was built to compete with the iPhone and other smartphones like Samsung Galaxy S4.

Mr Woodside, the chief executive said “The Moto G solves that problem  for one fifth of the cost of an iPhone 5s. We really built this to compete with the iPhone: it’s got a 25% per cent bigger display than the 5s, Qualcomm’s latest quad processor, 18 different combinations of backs and a guaranteed update to the latest Android experience”.

There is the question of whether Moto G will turn around Motorola’s disappointing fortunes in the smartphone market. Motorola lost nearly $250 million in the third quarter and analysts say that the sales of the Moto X range are mediocre. Nevertheless, the Moto X is only in sale in the US, where it is hard to break the stronghold of Samsung and Apple. The Moto G may gain interest in developing countries, where some people rely on their phones to do mobile banking where access to financial services may be hard. Motorola offering a high performance phone at an affordable price is a great strategy in welcoming those with little to spend.

Will Moto G be a success? It is yet to be seen.
